TERMS OF SALE
These Terms of Sale govern your shopping experience and any purchases of Arsenal Jackets products made through our official Arsenal Jackets stores and website within the United States of America. If you are purchasing our products outside the US, different terms may apply. Please read these terms carefully before placing your order online or purchasing from any Arsenal Jackets retail location.
By accessing and shopping at Arsenal Jackets stores or making a purchase from Arsenal Jackets, you agree to be bound by these Terms of Sale. If you do not agree with any part of these terms, please refrain from using our digital stores, visiting our retail locations, making a purchase, or ensure you return any eligible products within the specified return period.
You may only purchase Arsenal Jackets products if you are of legal age in your jurisdiction, or if you have obtained permission from a parent or legal guardian.
WHERE THESE TERMS APPLY
These Terms of Sale (“Terms”) apply to your shopping, orders, purchases, and returns at Arsenal Jackets’ physical retail stores (“Retail Stores”) as well as through our official online platforms, including our website and mobile app (“Digital Stores”). Collectively, our Retail Stores and Digital Stores are referred to as “Arsenal Jackets Stores.”
These Terms establish a legally binding agreement between you and Arsenal Jackets (“Arsenal Jackets,” “we,” “us,” or “our”), headquartered in Greenback, USA. We reserve the right to update or amend these Terms at any time. The most current version of the Terms will always be available on our website and will apply to your purchase at the time of order.
By shopping or making a purchase at any Arsenal Jackets Store, you also agree to be bound by our Privacy Policy and Website Terms of Use, which are incorporated into these Terms by
reference.
PURCHASING PRODUCTS
No Purchase for Resale
Arsenal Jackets products and the policies related to their purchase are intended exclusively for end consumers. Buying products with the intention to resell them to others—whether consumers, businesses, or third parties—is strictly prohibited. If we determine that a purchase or order is intended for resale, Arsenal Jackets reserves the right to take appropriate actions at our sole discretion. These may include suspending any policies or benefits designed for direct consumer purchases, restricting sales to specific customers or accounts, cancelling orders, applying restocking fees, limiting purchase quantities, refusing refunds or returns, denying access to our stores, or suspending or closing accounts.
How to Purchase – Digital Stores
To place an order through our Digital Stores, you must provide accurate information including your full name, valid email address, delivery address, and payment details. For full functionality of our online store, such as customizing items, adding products to your basket, and submitting orders, you may need to enable cookies and pop-ups in your browser settings.
Once you submit an order, you will receive an email confirming we have received your order (“Order Confirmation”). Your order is accepted when we dispatch the products, at which point you will receive a second email confirming shipment. If a product is unavailable, we will notify you promptly and will not process that portion of your order.
Our Right to Reject Your Purchase or Cancel an Order
At Arsenal Jackets, all product sales and order fulfillment are subject to product availability and our inventory management policies. We reserve the right to limit, refuse, or cancel any order or sale at our discretion, without liability beyond refunding any payment you have made. Reasons for this may include, but are not limited to:
- Circumstances beyond our control are impacting operations.
- The item you wish to purchase is out of stock or unavailable.
- Incorrect or unverifiable billing, shipping, or payment details.
- Orders flagged by our security systems for potential fraud or placed using automated software;
- Evidence that your order(s) were made for resale, tax evasion, or fraudulent purposes.
- Orders flagged for shipment to freight forwarders or addresses that facilitate export or sales tax avoidance.
- Exceeding established purchase quantity or spending limits.
- Excessive return history associated with your account.
- Determination that you are ineligible to make purchases.
- Pricing, typographical, or other errors on our website or in-store.
Arsenal Jackets will make final decisions on these matters at its sole discretion.
Title Transfer and Risk of Loss
For purchases made online, ownership and risk of loss transfer to you as soon as we hand over the product to the delivery carrier. If you choose to pick up your order directly from an Arsenal Jackets retail store, ownership and risk transfer upon your authorized receipt of the product. Please note that ownership of the product does not transfer until we have received full payment in cleared funds.
Indemnification and Release
To the fullest extent allowed by law, you agree to indemnify, defend, and hold harmless Arsenal Jackets, its affiliates, employees, officers, agents, and suppliers from any claims, damages, liabilities, losses, costs, or expenses, including legal fees, arising from your actions related to the use of Arsenal Jackets stores or services, violations of these Terms of Sale, applicable laws, or infringement of any third-party rights. Furthermore, you hereby release Arsenal Jackets and its related parties from any claims or causes of action that may arise in connection with your conduct or use of our services.
LIMITATION OF LIABILITY
These Terms represent the complete agreement between you and Arsenal Jackets concerning any claims related to your shopping experience, orders, purchases, returns, or use of our stores.
To the fullest extent permitted by applicable law, our total liability to you for any claims arising out of or connected to these Terms, whether based in contract, warranty, tort, statute, or otherwise—is limited to the amount you paid to Arsenal Jackets for the specific product(s) involved in the transaction.
Furthermore, to the greatest extent allowed by law, Arsenal Jackets and its affiliates will not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits or data, arising from your use or inability to use our stores, the performance of purchased products, or any actions by other users. This applies even if we have been advised of the possibility of such damages. You accept full responsibility for your use of and access to our stores, and your sole remedy for any dissatisfaction or damages is to cease using our services.
If any provision of this limitation is found to be invalid or unenforceable, our liability will remain limited to the maximum extent permitted by applicable law.
DISCLAIMER OF WARRANTY
At Arsenal Jackets, we provide access to our stores and products “as is” and “as available,” without making any promises or guarantees about their performance or suitability. We do not offer any express or implied warranties, including but not limited to guarantees of merchantability, fitness for a particular purpose, ownership, or non-infringement.
While we strive to provide accurate and up-to-date information about our products, including pricing, availability, and sizing, we cannot guarantee that all details are completely accurate or current at all times. Similarly, our digital stores may occasionally experience interruptions, errors, or technical issues beyond our control, including potential bugs or harmful components.
Please note that this disclaimer applies to the fullest extent allowed by law, but it does not affect any specific product warranties provided by us or the manufacturers of the merchandise you purchase.
DISPUTES
Choice of Law, Jurisdiction, and Time Limits for Claims
You agree that these Terms and any disputes between you and Arsenal Jackets will be governed by the laws of Oregon, USA, without applying its conflict of law rules, and not by international treaties like the 1980 U.N. Convention on Contracts for the International Sale of Goods. Unless local laws say otherwise, any disputes related to your orders or purchases from Arsenal Jackets will be handled individually, not as class actions, and will be resolved only in state or federal courts located in Multnomah County, Oregon. By agreeing to this, you also waive any objections about the court’s location or personal jurisdiction. Please note that any claims you have must be brought within one year after the issue arises, unless a longer period is required by law.
Right to Assign, No Waivers, and Severability
Arsenal Jackets reserves the right to transfer its rights and responsibilities under these Terms to another party at any time without notifying you, except where the law requires us to do so. This won’t affect your rights or our commitments to you. You can only transfer your rights or obligations to someone else with our written consent. If we don’t enforce these Terms strictly right away, it doesn’t mean we’re waiving our rights. Any waiver will only be valid if given in writing and won’t apply to future breaches. You should assume these Terms remain fully in effect. Finally, if any part of these Terms is found to be invalid or unenforceable by a court, the rest will continue to apply as intended.
PRICE AND PAYMENT
Accepted Payment Methods
At Arsenal Jackets, we offer a variety of secure payment options to make your checkout smooth and hassle-free. For online purchases through our website, you can find the complete list of payment methods available in the Help section. When shopping in our physical stores, payment options are clearly displayed at the register. Please note that any use of gift cards is subject to the specific terms and conditions outlined on our Gift Card page. We kindly ask that you only use payment methods listed on our site or in-store, as we cannot be responsible for any losses or issues that arise from unauthorized payment attempts.
How Payment Is Processed
For most orders placed on our website, including ready-to-ship products, we will temporarily hold (pre-authorize) the payment amount on your card when you place your order. The final charge will be completed once your order is dispatched. For made-to-order or customised items, the payment process may differ, and specific terms will be communicated at checkout.
Pricing and Currency
Prices for our products are shown in US dollars and do not include applicable sales tax. Shipping fees are calculated separately and applied to each order. While we strive to keep our prices consistent, they may be updated periodically. However, any price change will not affect orders that have already been confirmed and acknowledged by us.
Your Total Cost
When shopping online, the total price shown at checkout includes estimated taxes and shipping charges (where applicable). This final price, including any updated taxes, will be detailed in your order confirmation email, which we recommend you save for your records. In-store purchases will have taxes and shipping fees, if any, displayed on your receipt. Your credit or debit card statement will reflect the full purchase amount, converted to your local currency if necessary.
If your card’s billing currency is not in US dollars, please be aware that your bank or card issuer will apply their own exchange rate and may charge additional fees. These charges are beyond our control and vary depending on your financial institution’s policies.
SHIPPING & DELIVERY – ONLINE ORDERS
Delivery Locations and Timing
We don’t dispatch orders on certain public holidays. For the exact dates and available delivery options, please check the Help section on our website. We only deliver to valid home or business addresses within the United States and its territories.
Multiple Shipments
Usually, your entire order ships in one package. However, sometimes items may arrive separately due to stock availability or other factors. We reserve the right to split your order into multiple deliveries if needed. If this happens, we’ll notify you by email at the address you used when placing your order. Don’t worry, you won’t be charged extra for any split shipments.
Checking Your Order Upon Arrival
When your order arrives, please inspect the packaging and items carefully. If you notice any damage, please refuse the delivery and contact our customer service team immediately for assistance.
Shipping Charges
Discounted Shipping for Members
Members of Arsenal Jackets may qualify for discounted shipping rates on orders that meet certain minimum amounts. These thresholds are set by Arsenal Jackets and may vary. For more information on qualifying orders and shipping discounts, please visit the Help section of our website.
RETURNS & CANCELLATIONS
Cancelling Orders Before They Ship — Online Store
You can cancel your order free of charge within 30 minutes after placing it, no questions asked. However, please keep in mind that we start processing orders almost immediately after they’re placed, so the cancellation window is limited.
If your order status shows as “Pending” or “On Hold,” it can no longer be cancelled. If you miss the 30-minute cancellation window, your items will be shipped to you and can be returned following our standard return process described below.
Returning Items After Purchase or Delivery
Unless an item is marked as “Final Sale” or otherwise specified, you’re welcome to return your purchase in line with our return policy available on our website at ArsenalJackets.com/returns. Items bought in-store can be returned at any Arsenal Jackets retail location. If you purchased online, you may return your order by mailing it back or visiting any Arsenal Jackets store.
RETURNS OF DEFECTIVE PRODUCTS
If you receive products that are faulty or don’t match your order, you have the right to return them. This does not impact any legal rights you have. Should your return be approved (at Arsenal Jackets’ sole discretion), we will refund your purchase price along with any shipping fees. REFUND DETAILS
All refunds will be made to the original payment method used for your purchase. This applies to all returns, whether made online or in-store. For full details on the return process and estimated refund times, please check the Returns section on our website.
CIRCUMSTANCES BEYOND OUR CONTROL
An Event Beyond Our Control includes any situation outside our reasonable influence, such as supply chain disruptions, strikes, civil unrest, terrorism, war (declared or undeclared), natural disasters like floods or earthquakes, pandemics, or failures of communication networks.
If such an event impacts our ability to meet our commitments:
- We will notify you as soon as we reasonably can.
- Our obligations will be paused, and timelines extended until the situation is resolved.
If delivery of your order is delayed due to such an event, we will coordinate a new delivery date with you once normal service resumes. You may cancel your order if you no longer wish to receive the products due to these unforeseen circumstances.
